The family of baseball Hall of Famer Tony Gwynn filed a lawsuit Monday against the tobacco industry over his death, according to a report by the New York Times.

The New York Times reported that the Gwynn family filed the wrongful-death suit in San Diego Superior Court against Altria Group, Inc., formerly known as Philip Morris, and the lawsuit accuses Altria and others for manipulating Gwynn into an addiction to chewing tobacco.

The former San Diego Padre died of salivary gland cancer in 2014.
