UPDATE: Casino witnesses say O.J. rumors not true

LATEST:  13 Action News spoke with people who spotted Simpson at The Cosmopolitan Wednesday. 

According to two witnesses, Simpson wasn't seen drinking and was not being unruly.

"He was very nice, very cordial," said Michelle Messer.

UPDATE: O.J. Simpson's lawyer, Malcolm LaVergne, told 13 Action News that the story about Simpson being drunk at The Cosmopolitan is completely untrue.

LaVergne says that Simpson is a social drinker, meaning he usually orders one drink and sips on it while socializing, and that he was eating chicken wings at the Cosmopolitan.

LaVergne also told 13 Action News that the hotel-casino had apparently decided before Simpson's visit to trespass him from the property. LaVergne says that after Simpson was notified, he left the hotel-casino quietly.

In addition, Simpson is challenging anyone with proof that he was drunk and belligerent to come forward. He is also taking steps to make sure that his probation officer is clear about what happened. 

LaVergne pointed out several times that the hotel-casino has the right to ban anyone they want for any reason.

According to TMZ, O.J. Simpson was allegedly thrown out of the Cosmopolitan hotel-casino in Las Vegas on Nov. 8 and banned from the property for life.

O.J. Simpson was booted from the Cosmopolitan Hotel in Las Vegas Wednesday night after allegedly getting wasted and then being extremely unruly.

Simpson had been frequenting bars at the hotel since his release from prison. Hotel staff tells TMZ ... at around midnight last night, Simpson was drunk and became disruptive at the Clique bar. We're told Simpson was angry at hotel staff and glasses broke at the bar.    - TMZ

We've reached out to the Cosmopolitan hotel-casino for confirmation and are awaiting a response.

This incident comes after we reported O.J. Simpson was photographed having drinks at the Red Rock hotel-casino last weekend.

The recent events at the Cosmopolitan could mean harsh repercussions for Simpson. As a part of Simpson's parole, he is not allowed to consume alcohol in excess of the legal limit of .08.

Both Sports Illustrated and TMZ ran reports on the terms of Simpson's parole.

He’ll also be subject to blood and breath tests for evidence of excessive consumption of alcohol – if Simpson were to violate any of the terms of his parole, he would risk being ordered back to prison, wrote SI.com.

O.J. Simpson's on his way to being released from prison, and once he's a free man he'll also be free to imbibe and smoke weed ... as long as he's responsible about it.

The conditions of Juice's parole allow him to "consume alcoholic beverages but not to excess." O.J. will occasionally be tested for it, but if his BAC is under .08 ... he's in the clear, TMZ wrote.

What that means for Simpson after last night's incident is unclear. It'll be hard to prove that he was in fact above the legal limit for alcohol consumption and not just acting unruly on his own accord.

Without an arrest, and subsequent breathalyzer or blood test, this remains nothing more than just a refusal of service from the Cosmopolitan to a customer.

A black-eye for Simpson, sure, but hardly enough to return to prison.
