Neither of the two people accused of having sex on the High Roller were in court Wednesday morning.
Chloe Alexis Scordianos, 21, of Hicksville, New York, and Phillip Frank Panzica III, 27, of Houston, Texas, were taken into custody on Feb. 5 after an employee observed them smoking and undressing inside a cabin during a ride on The High Roller Observation Wheel.
Scordianos and Panzica were arrested and charged with commission of certain sex acts in public.
On Wednesday, Panzica's attorney was told he has 45 days to enter a plea with his next court hearing April 25. A plea deal was extended to bring the felony charges to a misdemeanor.
"I think this was overcharged to begin with," said his attorney, Bennair Bateman. "I think this misdemeanor charge is fair."
Panzica's fiance bailed him out of court following the incident.
Meanwhile, Scordianos has a preliminary hearing scheduled for April 12. Her attorney wants to review video before they take a plea deal to see all the evidence.
"We want to review the video," says her attorney, Chris Rasmussen. "You don't just take the police's word for what the evidence is."
