UPDATE: Cliven Bundy, the father of Ammon Bundy and Ryan Bundy and a Nevada rancher, was arrested in Oregon on Wednesday night as he was attempting to reach the wildlife refuge.

The Oregonian is reporting that the elder Bundy was arrested on federal charges stemming from the standoff with the U.S. Bureau of Land Management in Nevada in 2014 over grazing fees.

The charges are: Conspiracy to Commit An Offense Against the United States; Assault on a Federal Law Enforcement Officer; Use and Carry of a Firearm in Relation to a Crime of Violence; Obstruction of the Administration of Justice; Interference with Commerce by Extortion; and Aiding and Abetting.

Bundy is scheduled to be in court in Oregon at 1:30 p.m.

According to the Washington Post, the occupiers have agreed to surrender on Thursday morning. However, they only agreed to do so as long as Nevada Assemblywoman Michele Fiore was there to act as a witness and ensure that the occupation ended peacefully.

Cliven's daughter-in-law, Briana Bundy, wife of Mel Bundy, says Cliven is only being targeted because he stands up for what's right.

"Cliven is a big threat to the federal government and their agendas because he is educated and he speaks his mind and he stands up for his rights," she told 13 Action News. "Every single one of those charges are indeed bogus."

EARLIER STORY

The FBI is moving in on the remaining occupiers in Oregon and Nevada Assemblywoman Michele Fiore is right in the middle of it.

Michele Fiore is on the phone with the occupiers as she tries to make her way to the Malheur National Wildlife Refuge near Burns, Oregon. She is currently trying to make her way to the refuge from the airport in Portland, which is more than 5 hours away.

The conversation is being streamed via YouTube. Shortly before 8 p.m., the dramatic phone call was being listened to by more than 62,000 people.

WARNING: Audio stream contains graphic language

Fiore can be heard saying that she is willing to negotiate with the FBI in behalf of the occupiers. She is also encouraging the occupiers to remain calm and has prayed with the occupiers over the phone at least twice.

The occupiers seem convinced that the FBI will not let them leave the refuge alive.

A man using the name of Gavin Seim is helping run the live stream via a phone call with the occupiers. Fiore repeatedly reminds the occupiers that their conversation is being live streamed and that the FBI will not do anything with the world watching.

The occupiers are David Fry (who can be heard yelling at the FBI over the live stream while trying to talk on the phone), Jeff Banta, and Sandy and Sean Anderson.

Wednesday marks the 40th day of the occupation which originally began with about 3 dozen individuals and was led by Ammon Bundy.

The FBI sent out release a few hours ago stating that one of the occupiers had ridden an ATV outside the barricades established by the militia. The FBI attempted to approach the driver, but he returned to the encampment at a high rate of speed.

The FBI apparently decided shortly after that they needed to take further action.

Fiore announced earlier this week that she was headed to Oregon on Wednesday ahead of a Thursday meeting involving lawmakers from several states who are members of a group called the Coalition of the Western States.

Around 7 p.m., a post on the Facebook page for the Bundy Ranch in Nevada called upon people to head to Oregon. The post also says that Cliven Bundy, who is Ammon's father, is headed to Oregon.
